These terms govern your use of cometworks.app and of the services Cometworks LLC ("Cometworks", "we") provides. Paid engagements are also governed by the written agreement you sign with us; where the two differ, the signed agreement wins.
The services
Cometworks builds and hosts websites for small businesses and operates phone, scheduling and messaging systems on their behalf, including business phone lines, appointment requests, reminders and review requests. What is included in a particular engagement, and what it costs, is set out in your agreement with us.
SMS / text messaging terms
You opt in to text messages by texting a Cometworks number first, or by giving us your mobile number and asking for texts when you book or take a call with us. By opting in, you agree to receive text messages from Cometworks LLC at the number you provide. Messages relate to your enquiry and to the services you use. Message frequency varies. Msg & data rates may apply. Consent is not a condition of purchase. Reply STOP to opt out at any time and HELP for help, or email hello@cometworks.app. Carriers are not liable for delayed or undelivered messages. Mobile information and opt-in data will not be shared with any third parties or affiliates for marketing purposes; see our Privacy Policy.
Using the site and services
- Provide accurate information in forms and on calls, and keep your contact details current.
- Do not use our services to send unlawful, deceptive or unsolicited messages, or to collect consent you do not have.
- Do not probe, disrupt or reverse-engineer our systems.
- Businesses using a Cometworks line are responsible for obtaining their own customers' consent to be contacted, for the accuracy of the details they give us, and for honouring appointments confirmed through the line.
Intellectual property
The site, its design and our software are ours. Websites and content we build for a client are licensed or assigned to that client as set out in their agreement. You may not copy or reuse our materials without permission.
Disclaimers
The site and services are provided "as is". Figures on the site are illustrative and modelled from stated assumptions unless labelled as measured. We do not guarantee that messages will be delivered on time or at all, that calls will connect, or that any business outcome will follow.
Limitation of liability
To the fullest extent permitted by law, Cometworks is not liable for indirect, incidental or consequential losses, and our total liability for any claim relating to the site or services is limited to the amount you paid us in the three months before the claim arose.
Termination
We may suspend or end access to the site or services for misuse. Paid engagements end as set out in your agreement. Opting out of SMS never ends a service; it only stops the texts.
Governing law
These terms are governed by the laws of the United States and of the state in which Cometworks LLC is organized, without regard to conflict-of-law rules.
Changes
When these terms change, the effective date above changes with it. Continued use after a change means you accept it.
